Applies to the Queen’s Education website, the desktop app, and the Android and iOS app listed as Hayeshika Fernando, together the “Platform”.
1. About these Terms
The Platform is operated by Queen’s Education Group (Pvt) Ltd, a private company incorporated in Sri Lanka under the Companies Act No. 07 of 2007, Company Registration No. PV 00260107, a business registered in Sri Lanka (“Queen’s Education”, “we”, “us”), founded by Dr. Hayeshika Fernando. These Terms and Conditions (“Terms”) govern your use of the Platform, its courses, live classes, recordings, materials, support services and store. By using the Platform you agree to these Terms, our Privacy Policy and our Return and Refund Policy. If you do not agree, do not use the Platform.
Because our students are children, a parent or guardian must read and accept these Terms and is responsible for the child’s use of the Platform.
2. Definitions
“Content” means all video lessons, PDF notes, papers, images and educational materials.
“Course” means any class, bundle, seminar, study pack or other offering.
“Support services” means the in-app chat or help assistant and the voice support line.
“You” or “User” means the registered student and, for a minor, their parent or guardian.
3. Eligibility and account registration
Provide accurate and complete information and keep it up to date.
Your login is personal to you. Sharing your login is prohibited, and each account may be used by one user only.
We may suspend or close accounts that give false information, share access, or breach these Terms.
4. Intellectual property and copyright
All Content is the exclusive property of Dr. Hayeshika Fernando and is protected by law.
You are granted a personal, non-transferable, non-exclusive right to access Content for your own study only, while your access is valid.
Strictly prohibited and may lead to legal action: screen-recording, downloading or copying Content; sharing, redistributing or selling it; posting it on social media; or circumventing content protection.
5. Fees, payment and access
5.1 How fees work
Each month’s classes are sold separately. A class is priced for the calendar month in which it runs, and payment for one month gives access to that month only. There is no automatic recurring charge and no subscription: you choose each month whether to buy the next one. Bundles (“packages”) are sold at a single price for their month, in place of the individual class prices.
Fees are payable in advance by card or online wallet through Dialog Genie. Access to a month’s classes, recordings and materials activates once your payment is confirmed.
5.2 Prices and taxes
All prices are shown in Sri Lankan Rupees (LKR) and are the total amount payable. Any applicable taxes are already included in the price shown, and no tax is added at checkout. Delivery charges, where they apply, are shown separately before you pay.
5.3 If a month is not paid
If a month’s fee is not paid, access to that month’s classes is suspended from the 1st of the month. A suspended account keeps its history and is restored automatically when payment is made. Suspension for non-payment is not termination, and no data is deleted.
6. Refunds and returns
Refunds and product returns are governed by our Return and Refund Policy, which forms part of these Terms. In summary: mistaken, overpaid, double and wrong-account payments may be refunded if reported within 7 days; classes are otherwise non-refundable once attended; physical goods may be returned within the stated window if damaged, defective or wrong; and digital items are non-refundable once accessed.
6.1 Delivery of physical items
We deliver anywhere in Sri Lanka. The delivery charge depends on your district and is shown at checkout before you pay. Digital items require no delivery and are made available in your account immediately after payment.
Orders are dispatched after payment is confirmed. Delivery times depend on the courier and your location. You must give an accurate delivery address and a contactable phone number; we are not responsible for a delay or a failed delivery caused by incorrect details or by no one being available to receive the order. Risk in the goods passes to you on delivery.
7. Class schedule, changes and free access
7.1 Schedule and changes
Live classes and recordings are delivered through the Platform and third-party services (for example Zoom, YouTube, Cloudflare). The classes included in a month, and their scheduled times, are published on the Platform before you buy.
We may, for technical or operational reasons or in an emergency, change the time or date of a class, and may add, update or remove Content and features. We will give notice through the Platform, a message or email where practicable.
7.2 If a class does not run
If a scheduled class does not run, we will either hold a replacement class in the same month, or make a recording of that class available, at our option. Where neither is possible, the fee for that class is credited against your next month’s fee. We do not guarantee any particular examination result.
7.3 Free class access
As a benefit for continuing students, we may give free access to the first week of the following month’s classes where the current month has been paid. New students may receive a free trial of the current month’s first week.
This is a benefit, not a purchased entitlement. The free window (by default the 1st to the 7th of the month), the classes it covers and the eligibility rules are set by us and may be changed, reduced or withdrawn at any time, generally or for an individual account. We may also grant free access at our discretion. Free access does not create any right to a refund, credit or extension.
8. Acceptable use and prohibited conduct
You must use the Platform lawfully and respectfully. The following are strictly prohibited on voice calls, in chat, in support tickets, and anywhere on the Platform.
8.1 Harassment and abusive behaviour
Harassing, bullying, threatening, intimidating or demeaning any person, including our staff and support agents.
Sexual harassment of any kind. This includes unwanted sexual advances, comments, requests or solicitation, and sending or requesting sexually explicit or inappropriate messages, images or audio. It is treated with zero tolerance, especially as our users are children.
Hate speech, or discrimination based on race, religion, gender, disability or similar grounds.
Obscene, vulgar, defamatory or otherwise inappropriate language or content.
Impersonating another student, parent, teacher or staff member.
8.2 Misuse of the service (prohibited activities)
Sharing your account, or accessing or attempting to access another user’s account or data.
Screen-recording, downloading, copying, redistributing or reselling Content, or circumventing content protection or security measures.
Reverse-engineering, decompiling, scraping, or using bots or automated tools against the Platform or its APIs.
Uploading malware, or attempting to disrupt, overload or gain unauthorised access to the Platform or its providers.
Misusing the support line, for example prank, repeated or nuisance calls, or spamming chat. Calls and chat are rate-limited, and abuse may lead to suspension.
Using the Platform for any unlawful purpose or in breach of applicable law.
9. Voice support calls
Our voice support line connects you to a support agent. Every answered call is recorded (audio) for quality, training, dispute resolution and safety, and is stored securely with restricted, audited access (see the Privacy Policy). You must not record our agents yourself, and must not use the line to harass, threaten or send inappropriate content.
10. Child safety (zero tolerance)
We have zero tolerance for child sexual abuse and exploitation (CSAE), grooming, or any content or conduct that endangers a child. Such activity will be removed, the account terminated, and the matter reported to the relevant Sri Lankan authorities and to platform providers such as Google as required. To report a child-safety concern, contact [email protected].
11. Reporting and enforcement
If you experience or witness harassment or a breach of these Terms, contact us at [email protected] or WhatsApp 076 347 5884. Where a user breaches these Terms we may, depending on severity: warn the user; suspend or block the account, with or without prior notice; force-logout all sessions; withhold access; terminate the account, which anonymises it; and, for serious matters, cooperate with and report to law-enforcement authorities. Suspension or termination is subject to the Return and Refund Policy where applicable. Our support agents may also report abusive behaviour on a call or in chat for supervisor review.
11.1 If we suspend or restrict your account
We will tell you that your account has been suspended and, so far as we reasonably can, why.
If you believe a suspension is a mistake, you may ask us to review it by contacting [email protected] or WhatsApp 076 347 5884, or through the “Account suspended?” link on the sign-in screen. We will review and respond within 7 days. If the suspension was our error, we will restore your access and extend your paid access by the time you lost.
Suspension for non-payment is not a penalty and is lifted automatically when payment is made (see Section 5.3).
12. Service availability and limitation of liability
We aim to keep the Platform available but do not guarantee uninterrupted or error-free service.
We are not responsible for interruptions caused by your own internet connection or device faults.
To the maximum extent permitted by law, we are not liable for indirect or consequential loss, and nothing excludes liability that cannot be excluded by law. We do not guarantee any particular exam result.
13. Third-party services
The Platform relies on third-party services: payment (Dialog Genie), SMS (text.lk), email (Resend), voice (Agora), live classes (Zoom), video streaming and delivery (Cloudflare, YouTube, Vimeo), storage (AWS), push (Firebase Cloud Messaging) and AI (Google Gemini). Your use of those services may also be subject to their own terms. We are not responsible for the acts or omissions of third-party providers. See the Privacy Policy for what each receives.
14. Termination
You may stop using the Platform at any time and request account deletion. We may suspend or terminate access for a breach of these Terms, subject to the Return and Refund Policy.
15. Governing law and disputes
These Terms are governed by the laws of Sri Lanka, and the courts of Sri Lanka have jurisdiction over any dispute.
16. General provisions
16.1 Indemnity. You agree to indemnify and hold harmless Queen’s Education, Dr. Hayeshika Fernando and our staff from any claim, loss or expense arising from your breach of these Terms or your misuse of the Platform.
16.2 Service provided “as is”. The Platform and the Content are provided “as is” and “as available”, without warranties of any kind except those that cannot be excluded by law. We do not warrant that the service will be uninterrupted or error-free, or that it will achieve any particular result.
16.3 Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
16.4 No waiver. Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
16.5 Assignment. You may not assign or transfer your rights under these Terms. We may assign these Terms to a successor or affiliate on reasonable notice.
16.6 Entire agreement. These Terms, together with the Privacy Policy and the Return and Refund Policy, form the entire agreement between you and us regarding the Platform, and supersede any prior agreements or understandings.
16.7 Force majeure. We are not liable for any delay or failure to perform caused by events beyond our reasonable control, for example natural disasters, power or internet outages, strikes, or acts of government.
17. Changes to these Terms
We may update these Terms at any time. The updated version will be posted with a new “Last updated” date, and significant changes notified through the website, a message or email.
